Do you think Frank Thomas will get a settlement from the Blue Jays?

When the Blue Jays benched then released him he had a 10 million dollar option for 2009, contingent upon him making 376 plate appearances. I remember Comiskey doing that to one of his pitchers (being the cause of the Black Sox scandal) so I'm wondering if the MLBPA has any stipulations on benching a player to avoid an option. Any opinions?
